Cruise Passenger Files Lawsuit Accusing MSC Cruises of Negligence

A cruise passenger from New Jersey filed a lawsuit alleging had been seriously injured when a metal ceiling panel fell down on her as she was getting off the vessel in 2016.

Last week, Janine Dayeh filed federal lawsuit in Miami accusing MSC Cruises of negligence. Dayeh was walking off MSC Divina on May 22 as a crew member examined the metal ceiling panel for water damage and it sudden came loose, the suit said. The panel hit Dayeh and several other passengers, the suit said.

Dayeh suffered multiple injuries to her body and ankle, the suit said. She also suffered mental anguish and post-traumatic stress, the suit said.

The Swiss cruise line failed to notify passengers of the danger and didn't take proper precautions to make sure passengers could exit safely, according to the lawsuit.

MSC was also allegedly negligent in doing maintenance work while passengers were in the area and in failing to ensure the panel was secured, the lawsuit said.

Dayeh is seeking an unspecified payment for damages as well as attorney fees.
